The New Mexico Supreme Court ruled that the body camera footage of a woman confessing to hiding her newborn baby in a hospital trash can in an attempt to conceal her pregnancy cannot be used by prosecutors in her murder case because of doctor-patient confidentiality.
Alexee Trevizo, who was 19 when she was arrested and charged with first-degree murder and tampering with evidence in 2023, was captured on police body camera admitting to hospital staff and her mother that she dumped the baby boy in the trash after workers reported the incident to authorities.
But the court ruled in a unanimous decision that all statements made in front of a police officer in the hospital room cannot be used at trial because her confession was protected under doctor-patient confidentiality, People reported.
The state's high court also upheld the Fifth Judicial District Court’s ruling that surveillance video showing Trevizo inside the hospital and any body camera footage captured by police were also not admissible in court.
