Senator Mark Warner (D-Va.) unveiled legislation on Monday, August 4, 2026, aimed at prohibiting social media companies from selling early or prioritized access to posts from government officials. This move follows the recent launch of Truth API by President Trump's media company, which provides Wall Street firms with advance access to Truth Social’s “most market-moving” posts.

The proposed bill, named the No Preferential Release of Federal Information for Transactions (NO PROFIT) Act, seeks to ban social media platforms from selling expedited access to accounts linked to the president, vice president, members of Congress, and other government employees. Additionally, the legislation would make it illegal to trade on "material information" obtained through such services.

Warner criticized the practice, stating, “The president’s company selling prioritized access to the president’s market-moving posts is misconduct and erodes public confidence. Americans should have free and equal access to public statements made by U.S. government officials.” He further emphasized that "early access to government information should not be sold to whoever will pay the price."

Trump Media & Technology Group (TMTG) announced plans to launch Truth API in mid-July 2026. Application programming interfaces (APIs) like Truth API allow software applications to communicate and share data, which can be utilized by investors in algorithmic trading programs. Truth Social remains a primary communication platform for former President Trump.

TMTG interim CEO Kevin McGurn stated, “Markets already move on Truth Social posts. Truth API delivers a direct, licensed, real-time feed of the platform’s most market-moving Truths while advancing our strategy to monetize proprietary assets through a high-margin, recurring revenue stream.”
