Republican political commentator Scott Jennings has called on Olympian David Hearn to sue the Trump administration following the Department of Justice's decision to drop charges against Hearn. The 67-year-old former Olympic canoeist was federally indicted by a Washington, D.C. grand jury on felony destruction of property charges, facing up to 10 years in prison for allegedly damaging the Lincoln Memorial Reflecting Pool.

Attorney for the District of Columbia Jeanine Pirro had accused Hearn of ripping a piece of recently installed sealant on the bottom of the Reflecting Pool. However, the criminal prosecution was dropped on Friday after Pirro shifted blame to contractors responsible for the installation, citing over spraying and delamination issues.

New filings revealed that "the rush to complete the project led to hasty and botched work that was not remediated before the project was finished and the fencing removed." It was also reported that a National Park Service engineer had raised concerns about peeling days before Hearn's arrest.

The Reflecting Pool renovation was contracted to Atlantic Industrial Coatings, a Virginia-based company awarded a no-bid contract, with costs escalating to $14.7 million by June. The project faced scrutiny after an algae bloom and peeling paint were discovered post-renovation.

In an interview on CNN's "The Source" with host Erica Hill, Jennings expressed concern over the DOJ's handling of the case, stating, "And, you know, after everything that was said, this guy, he is owed an apology."

Jennings emphasized that Hearn "ought to sue" the administration for the attempted prosecution related to the Reflecting Pool damage.
