A Canberra woman, Julie Elizabeth Fallon, who fatally struck motorcyclist Simon Smith after veering into oncoming traffic, has avoided jail time. Earlier this year, an ACT Supreme Court jury found Fallon guilty of culpable driving causing the death of 55-year-old Simon Smith in May 2024.

Fallon was driving a red Mitsubishi Outlander when she crossed double white lines into oncoming traffic on Athllon Drive, hitting Mr. Smith as he rode to work. Dash-cam footage presented in court showed her swerving in front of another car before the collision.

Chief Justice Lucy McCallum sentenced the 54-year-old to three years' imprisonment, to be served in the community under an Intensive Corrections Order, noting that jail would "pile trauma upon trauma" for her family. The judge found Fallon had driven for about 25 seconds with impaired vision due to fog and morning sunlight, traveling approximately 240 meters before failing to negotiate a bend.

Chief Justice McCallum stated Fallon had become "unduly preoccupied" and "wholly failed to heed or comprehend the risk" by continuing to drive with limited visibility, which "compounded the danger of continuing to drive" and "involved a substantial risk of catastrophic outcome." The judge also remarked it was regrettable Fallon had not heard the "gracious sentiments" from Mr. Smith's loved ones but found her behavior consistent with post-traumatic stress disorder symptoms rather than a lack of remorse.

Simon Smith died in hospital two days after the crash. The case highlights the serious consequences of impaired driving and the responsibility drivers hold, as "every time we get behind the wheel of a car we're in charge of a lethal weapon."
